HB 281 Summary

• Expands tobacco and nicotine prohibitions in public schools to include all persons, not just students, and applies to all school-controlled areas including outdoor facilities.

• Adds new definition of "use nicotine" to prohibit possession and consumption of nicotine-containing substances by any means (smoking, heating, chewing, absorbing, dissolving, or ingesting) in school settings.

• Requires school districts and educational service centers to adopt enforcement policies against all persons for tobacco and nicotine violations, and establish disciplinary measures specifically for student violations.

• Applies tobacco and nicotine restrictions to community schools, science and technology schools, and college-preparatory boarding schools by adding section 3313.751 to their compliance requirements.

• Takes effect July 1, 2014, with provisions continuing an earlier version of section 3326.11 that was scheduled for that date.
