H.B. 392 Summary
-
Creates qualified immunity from prosecution for underage alcohol possession or consumption violations if law enforcement discovers the offense solely because the person sought medical assistance for themselves or another, or called 911 to report a crime.
-
Immunity requires the person to use their own name when seeking medical assistance and, if helping another person, to have acted in good faith as the first to call for help and remained until assistance arrived.
-
Applies to violations of Ohio Revised Code sections 4301.631 (low-alcohol beverages), 4301.69 (beer and intoxicating liquor), and 4301.691 (conditional provisions if federal drinking age mandate is repealed).
-
Amends existing alcohol statutes to reference the new immunity provision and clarifies that immunity protects against prosecution, unruly child adjudication, and delinquent child adjudication.
