HB 456 Summary

• Amends Ohio Revised Code Section 4112.05 to clarify that unlawful discriminatory compensation practices occur each time wages, benefits, or other compensation is paid resulting from a discriminatory compensation decision.

• Establishes three instances when unlawful discriminatory compensation practices are committed: when adopted, when an individual becomes subject to the practice, and each time compensation is paid pursuant to the discriminatory decision.

• Allows complainants to recover back pay for up to two years preceding the filing of a charge if the discriminatory practice during the filing period is similar or related to compensation discrimination occurring outside the standard filing deadline.

• Declares the amendments remedial rather than punitive in nature, intended to codify the "Lilly Ledbetter Fair Pay Act of 2009" at the state level.

• Retroactively applies amendments to all pending discrimination claims under Chapter 4112 of the Revised Code as of May 28, 2007.
