SB 255 Summary

• Permits drivers to present proof of financial responsibility to the Registrar of Motor Vehicles, peace officers, traffic violations bureaus, and courts using an electronic wireless communications device (smartphone, tablet, laptop, etc.).

• Defines "electronic wireless communications device" to include wireless telephones, personal digital assistants, computers, and substantially similar wireless devices designed to communicate and display text or images.

• Requires insurers to provide policyholders the ability to utilize electronic devices to present proof of financial responsibility, with text or images conforming to registrar-prescribed rules.

• Specifies that only the evidence of financial responsibility displayed on the device may be viewed; no other device content shall be accessed, and the person assumes risk of device damage unless caused by purposeful, knowing, or reckless action.

• Prohibits proof of financial responsibility that must be filed and maintained with the registrar during suspension periods from being presented through electronic devices; physical documents remain required for filing purposes.
