Allows type B family day-care homes to accommodate more than six children on the premises if the additional children are at least six years old and related to or in legal custody of the administrator

Establishes that all children under six years of age present at a child care facility count toward determining whether it qualifies as a child day-care center, type A home, or type B home, regardless of relation to staff

Creates new statutory definition clarifying that "legal custody" has the same meaning as in section 2151.011 of the Revised Code

Removes previous language that excluded related children under six years of age from being counted toward facility capacity limits

Amends sections 5104.01 and 5104.38 and enacts section 5104.023 of the Revised Code to implement these changes to child care facility classifications
