Enacts section 125.083 of the Revised Code to require state agencies to set aside approximately 20% of purchases for competition limited to small business enterprises.

Defines "small business enterprise" as any person with a principal place of business or research in Ohio that meets the requirements of a "business concern" under 13 C.F.R. 121.702.

Requires the Department of Administrative Services to set aside 20% of its competitively selected purchases for small businesses, with exemptions for the legislative and judicial branches, boards of elections, and the adjutant general.

Allows set-aside purchases to be made through usual procedures if no small business bids are submitted, and requires agencies to set aside additional purchases as needed to ensure approximately 20% of total annual contracts are awarded to small businesses.

Designates intentional misrepresentation as a small business enterprise for purposes of obtaining contracts as theft by deception under Ohio law, and permits small businesses to compete for non-set-aside purchases.
