S.B. No. 91 Summary

• Requires pharmaceutical manufacturers and labelers selling dangerous drugs to report annually to the Ohio Director of Health the name and address of their compliance officer by January 1st.

• Mandates manufacturers and labelers submit detailed reports by February 1st disclosing all gifts, fees, payments, subsidies, or economic benefits provided to prescribers, hospitals, nursing homes, pharmacists, and health benefit plan administrators in connection with drug marketing and detailing activities.

• Exempts from disclosure gifts valued under $25, sample drugs intended for patient distribution, clinical trial compensation and expenses, and scholarships for medical students and residents attending professional conferences.

• Imposes a fine of up to $10,000 per violation for manufacturers and labelers that fail to make required disclosures, with each violation treated as a separate offense.

• Requires the Director of Health to submit an annual summary report to the Governor and General Assembly by June 1st and authorizes the Attorney General to seek injunctive relief and attorney's fees for violations.
