Substitute House Bill 18 Summary

• Prohibits manufactured home park operators, condominium associations, neighborhood associations, and landlords from restricting display of the U.S. flag, Ohio flag, POW/MIA flag, blue star banners, gold star banners, and other service flags on residential property.

• Allows flag displays if they comply with federal and state patriotic customs (4 U.S.C. 5-10, 36 U.S.C. 902), federal law, state law, local ordinances, or presidential/gubernatorial proclamations.

• Requires tenants to provide reasonable notice to park operators or landlords before installing flagpoles or brackets, and mandates discussion of placement, cost, installation quality, lighting, and appropriate size consistent with the property.

• Declares any rental agreement restriction on permitted flag displays is against public policy and unenforceable as an unconscionable term.

• Park operators and landlords are not liable for damages arising from flag installations when they do not receive required tenant notifications.
