H.B. 221 Summary

• Expands the definition of "use tobacco" to include any substance derived from tobacco, and adds a new definition of "use nicotine" to cover all forms of nicotine consumption including smoking, heating, chewing, absorbing, dissolving, or ingesting.

• Prohibits all persons (not just pupils) from smoking, using tobacco, or possessing tobacco in school district and educational service center facilities and outdoor areas, or at school-supervised activities.

• Prohibits all persons from using nicotine or possessing nicotine-containing substances in school facilities, outdoor areas, and school-supervised activities.

• Requires boards of education and educational service center governing boards to adopt policies enforcing these prohibitions against all persons and establishing disciplinary measures for student violations.

• Amends sections 3314.03, 3326.11, and 3328.24 to add section 3313.751 to the list of laws that community schools, STEM schools, and college-preparatory boarding schools must comply with as if they were school districts.
