H.B. 273 Summary

• Park operators may provide written notice to remove abandoned manufactured homes, mobile homes, or recreational vehicles within 14 days of eviction judgment and 3 days of abandonment.

• Park operators must search public records and identify all persons with outstanding rights or interests in abandoned homes before pursuing removal, and must conduct reasonably diligent inquiries.

• For homes valued at $3,000 or more, sheriffs must commence sale proceedings within 60 days following court-ordered writ of execution, with proceeds distributed to cover removal costs, taxes, liens, judgment debts, and remaining funds as unclaimed property.

• For homes valued under $3,000, sheriffs may destroy the home, proceed with sale, or transfer title to the park operator within 30 days of receiving the writ, with notice to all persons with outstanding interests.

• Enacts Section 4781.56 permitting the manufactured homes commission to contract with health departments to abate and remove abandoned homes that constitute nuisances, with removal costs paid by the park operator.
