HB 284 Summary

• Adds extortion (section 2905.11), perjury (section 2921.11), and certain federal offenses to crimes triggering forfeiture or termination of public retirement system benefits for public employees convicted while serving in a position of honor, trust, or profit.

• Applies forfeiture to members of five major Ohio public retirement systems: Public Employees Retirement System (PERS), Ohio Police and Fire Pension Fund, State Teachers Retirement System (STRS), School Employees Retirement System (SERS), and State Highway Patrol Retirement System (SHPRS).

• Requires prosecutors and the Attorney General to notify affected retirement systems when charges are filed or convictions occur under specified offenses, and allows offenders to request hearings regarding forfeiture orders before courts impose penalties.

• Allows courts to order termination of disability benefits if the disabling condition arose from commission of the offense for which the offender was convicted.

• Prohibits restoration of canceled service credit after forfeiture, and creates a new misdemeanor offense for failure to report charges or convictions to retirement systems as required by law.
