H.B. No. 35 Summary

• Prohibits any agency or employees from seizing firearms from lawfully possessed individuals, except when law enforcement reasonably believes immediate seizure is necessary for safety of the officer or another person, or to preserve evidence in a criminal investigation.

• Requires law enforcement officers to return seized firearms to owners if the person is not arrested, the firearm is not needed as evidence, and the reason for seizure no longer exists.

• Prohibits establishment of firearm registries and bans law enforcement officers, federal officers, and international agents from enforcing any firearm registration requirements or firearm bans enacted after the bill's effective date.

• Prohibits political subdivisions from enacting ordinances or rules requiring firearm registration or establishing firearm registries.

• Establishes violation of firearm registration or ban enforcement as a first-degree felony offense.
