H.B. No. 380 Summary

• Requires each law enforcement agency to adopt a written policy within 60 days regarding investigation of officer-involved deaths where a firearm is used on or off duty within scope of law enforcement duties.

• Mandates criminal investigations of officer-involved deaths conducted by panels of three or more investigators, including one from the involved agency and two or more investigators referred by the attorney general from a statewide pool.

• Requires the attorney general to maintain a database of designated investigators and randomly select qualified officers from different transportation districts to investigate deaths, with selected officers able to decline service.

• Requires investigatory panels to submit complete investigation reports to the prosecutor and law enforcement agencies within 30 days, with public release of reports (minus confidential records) if the prosecutor finds no basis to prosecute or a grand jury returns a no bill.

• Requires investigatory panels to promptly inform family members of the deceased of contact information for the prosecutor's office handling the case.
