Director of Job and Family Services must request a federal waiver from the U.S. Secretary of Agriculture to waive section 6(o)(2) of the Food and Nutrition Act of 2008 for areas with unemployment rates exceeding 10 percent or insufficient job availability.

Director must request the waiver for all qualifying areas of the state and for the entire state when it qualifies, including when the U.S. Department of Labor determines Ohio qualifies for extended unemployment benefits.

Director must submit a new waiver request each time one or more areas or the entire state becomes newly qualified based on any data and evidence authorized by federal statutes, regulations, and guidance.

Director must also request the waiver whenever the U.S. Secretary of Agriculture indicates the waiver would be granted.
