Director of Agriculture and Director of Health must jointly adopt rules establishing procedures for reviewing inspections conducted by registered sanitarians and sanitarians-in-training of retail food establishments and food service operations.

Rules must establish performance standards where reviewers identify critical violations missed by inspectors, with allowances of: one missed violation if 1-5 critical violations found; two missed violations if 6-10 critical violations found; two or 10% of violations missed (whichever is greater) if more than 10 critical violations found.

Rules must require inspectors to verbally identify or document noncritical violations and reviewers to document all noncritical violations on a jointly approved form and compare them immediately after inspection.

Reviews must be included in board of health surveys, and Directors must jointly develop an annual report identifying the most common violations not identified by inspectors and provide it to the Senate President, House Speaker, Ohio Environmental Health Association, and Association of Ohio Health Commissioners.

Rules do not apply to sanitarians who annually conduct five or fewer standard inspections or who solely inspect vending, temporary food service, or temporary retail food establishments.
