OH HJR4

Amends Section 1e of Article II of the Ohio Constitution to prohibit initiated constitutional amendments that grant monopolies, oligopolies, or cartels, specify tax rates, or confer commercial interests, rights, or licenses unavailable to similarly situated persons or entities.

Requires the Ohio ballot board to place two separate ballot questions if an initiative amendment conflicts with these prohibitions: the first asking if the petitioner may proceed despite the violation, and the second describing the proposed amendment.

Constitutional amendment takes effect only if both questions are approved by a majority of electors voting on them; if only one is approved, the amendment fails.

Exempts any amendment approved on November 3, 2015 creating a monopoly, oligopoly, or cartel for federal Schedule I controlled substances from taking effect, regardless of severability provisions.

Grants the Ohio Supreme Court original and exclusive jurisdiction over actions relating to this section, with the amendment taking immediate effect upon voter approval.
