Sub. S.B. No. 146 Summary

• Establishes enhanced penalties for moving violations committed while distracted if the distracting activity is the apparent cause of the violation.

• Creates new section 4511.991 defining "distracted" as using a handheld electronic wireless communications device (with certain exceptions) or engaging in any activity that impairs the ability to drive safely.

• Permits offenders to pay an additional fine of up to $100 or elect to attend a distracted driving safety course as an alternative.

• Applies the distracted driving penalty enhancement to violations of 49 specified traffic law sections.
