Requires owners of horizontal wells to develop and implement emergency response plans addressing emergencies at surface locations that threaten public health or safety during construction, drilling, well stimulation, production, plugging, and surface restoration.

Plans must incorporate national incident management system standards and include emergency contact information, notification procedures, employee response actions for fires/medical emergencies/explosions/spills/security breaches, safety data sheets, fire suppression and spill control equipment locations, nearby occupied structures within one-half mile, and emergency response training requirements.

Plan development required within 90 days of the effective date for existing wells or within 30 days of permit issuance for new wells; owners must annually review and update plans and maintain a current copy at the well site.

Plans must be submitted within 30 days of development and annually thereafter to the division of oil and gas resources management, emergency response commission, local emergency planning committees, emergency management agencies, county sheriff's offices, and applicable fire departments.

Violations subject to civil penalties of $1,000 for the first week of non-compliance and an additional $500 for each subsequent week; penalties deposited into the oil and gas well fund.
