S.B. No. 205 Summary

• Requires residential rental properties with dwelling areas above the second story to have a separate exterior means of egress (unblocked window with ladder or staircase) unless the property has a fire suppression system.

• Defines "exterior means of egress" as an unblocked, functional window that can be opened from inside and a ladder or staircase extending no more than five feet above ground level.

• Applies to structures originally constructed or designed as single-family dwellings being leased as multi-family dwellings, excluding hotels and college/university dormitories.

• Provides qualified immunity from civil liability for landlords who in good faith comply with exterior egress requirements, unless their conduct constitutes willful, wanton, reckless, or grossly negligent misconduct.

• Amendment to section 3781.104 takes effect six months after the act's effective date; other amendments are effective upon enactment.
