Requires public and chartered nonpublic schools to open for instruction with students in attendance after Labor Day beginning in the 2017-2018 school year, allowing only pre-Labor Day workshops and orientation for staff.

Permits boards of education to adopt a resolution allowing schools to open before Labor Day if they determine it is in the school's best interest, with a public hearing required at least 30 days prior for city, exempted village, and local school districts.

Exempts school districts with existing collective bargaining agreements establishing pre-Labor Day opening dates from compliance until agreement expiration; all new or renewed agreements must comply with the requirement.

Does not prevent schools from operating summer school programs or apply to schools meeting minimum instructional hours through year-round attendance including summer sessions.

Applies the Labor Day opening requirement to community schools, STEM schools, and college-preparatory boarding schools through amendments to related code sections.
