Sub. H.B. 332 Summary

• Prohibits covered entities (hospitals, health professionals, transplant centers, and related facilities) from denying transplantation services or anatomical gifts solely based on an individual's disability.

• Requires covered entities to make reasonable modifications to policies and procedures to provide access to transplantation services, unless modifications would fundamentally alter the nature of services.

• Allows consideration of disability only if a physician determines it is medically significant, and prohibits considering inability to comply with post-transplant medical requirements as medically significant if support persons or auxiliary aids are available.

• Permits affected individuals to file civil actions in common pleas court for injunctive relief and equitable remedies, with courts applying the same standards used in federal Americans with Disabilities Act cases.

• Prohibits health insurance issuers from denying coverage for anatomical gifts, transplantation, or related treatment services solely based on a covered person's disability.

• Appropriates $2,500,000 in fiscal year 2019 to the Department of Medicaid for Positive Education Program Connections in Cuyahoga County.
