S.B. No. 180 Summary

• Shifts burden of proof to prosecution to disprove self-defense claims beyond reasonable doubt, rather than defendant having to prove self-defense by preponderance of evidence.

• Expands "no duty to retreat" protections for use of force in self-defense, defense of another, or defense of residence to include any place where a person lawfully has a right to be (not just home and vehicle).

• Modifies concealed handgun licensing requirements regarding licensee conduct during law enforcement stops, including clarifications about keeping hands in plain sight and conditions for officers returning surrendered firearms.

• Reduces penalties for certain concealed handgun violations and changes offense classifications under various circumstances involving firearms in motor vehicles.

• Repeals section 2923.1212 and allows expungement of prior convictions for firearm violations that no longer constitute crimes under the amended law.
