Substitute Senate Bill No. 20 Summary

• Requires an additional mandatory prison term of 6 years for offenders convicted of felonious assault if the victim suffered permanent disabling harm and was under 10 years of age at the time of the offense

• Defines "permanent disabling harm" as serious physical harm resulting in permanent injury to intellectual, physical, or sensory functions that substantially impairs a person's ability to meet ordinary demands of life

• Creates new specification section 2941.1426 that must be included in the indictment, count, or information charging the offense to trigger the mandatory 6-year term

• Prohibits imposition of any other additional prison term for the same offense if the 6-year term is imposed

• The legislation is known as "Destiny's Law" and applies to violations of division (A) of section 2903.11 (felonious assault)
