Sub. S.B. No. 33 Summary

• Allows disclosure of defendant's traffic and criminal records from the law enforcement automated data system (LEADS) to the defendant and defendant's counsel when formally requested through discovery rules in traffic or criminal cases.

• Authorizes courts to continue an offender on intervention in lieu of conviction with additional terms and conditions if the offender violates any terms, rather than automatically entering a finding of guilt.

• Permits state highway patrol troopers who complete approved in-service training to administer oaths and acknowledge criminal and juvenile court complaints, summonses, affidavits, and returns of court orders related to their official duties.

• Provides immunity from civil and criminal liability for prosecutors and persons assisting them who disclose LEADS information in the manner authorized by this section.

• Allows redaction of residential addresses, dates of birth, social security numbers, and photographs of witnesses, law enforcement officers, and prosecutors from discovered information.
