HB 318 Summary: Kratom Consumer Protection Act

• Defines "kratom product" as food containing any part of a leaf from the plant Mitragyna speciosa and establishes registration requirements for food processing establishments and retail food establishments that handle kratom products.

• Prohibits sale of kratom products that contain poisonous or deleterious ingredients, synthetic alkaloids, levels of 7-hydroxymitragynine greater than 2% of alkaloid composition, or lack labeling showing mitragynine and 7-hydroxymitragynine amounts.

• Requires all kratom products to include labels disclosing the factual basis for representing the food as a kratom product and prohibits sale of kratom products to individuals under 18 years of age.

• Directs the Director of Agriculture and Director of Health to adopt rules establishing registration procedures, testing and labeling standards, civil penalties for violations, and procedures for seizing non-compliant products.

• Allows individuals to bring civil actions for damages resulting from violations and establishes criminal penalties ranging from second-degree misdemeanor for certain violations.
