H.B. No. 391 Summary

• Increases Ohio's minimum wage to $10.55 per hour effective January 1, 2021, and requires the director of commerce to adjust the wage rate annually in accordance with the Ohio Constitution.

• Prohibits political subdivisions from establishing minimum wage rates different from the state minimum wage rate required under this section.

• Requires employers to maintain records for three years of employee names, addresses, occupations, pay rates, hours worked daily, and total wages paid, with provisions allowing employees to request their own information within 30 business days.

• Establishes enforcement mechanisms allowing employees, interested parties, and the state to file complaints for wage violations; permits civil actions for equitable and monetary relief with damages calculated as back wages plus an additional two times the back wages amount.

• Repeals section 4111.07 of the Revised Code and amends sections 4111.02, 4111.09, and 4111.14 to implement the minimum wage increase and related employment protections.
