Am. H.B. No. 509 Summary

• Amends section 3721.02 of the Revised Code to establish expedited licensure inspection procedures for residential care facilities licensed under section 5119.34 that serve three to sixteen unrelated adults.

• Director of health must commence expedited licensing inspections no later than ten business days after receiving a properly submitted request from an applicant seeking a new license or approval to increase/decrease capacity or make other changes requiring inspection.

• Director may charge a fee for expedited licensing inspections or plan reviews that is adequate to cover costs, with fees deposited to the general operations fund and used solely for expediting inspections and reviewing plans.

• Expedited inspection procedures shall be included in rules established by the director and are exempt from certain regulatory review requirements under section 121.95 of the Revised Code.

• Inspection results and deficiency statements remain restricted from use in courts and advertisements unless specific conditions are met, though results may still be used in criminal investigations and prosecutions.
