Am. H.B. No. 61 Summary

• Adds forensic mental health providers, mental health evaluation providers, regional psychiatric hospital employees, emergency service telecommunicators, and certain Ohio National Guard members to "designated public service workers" whose residential and familial information is exempt from public disclosure under Ohio Public Records Law.

• Enacts Section 107.22 requiring that contact tracing orders for contagious disease outbreaks be voluntary, require written consent, prohibit penalties for non-participation, and cannot withhold medical treatment based on refusal.

• Records created during contact tracing and monitoring efforts are not public records and disclosure of protected health information is subject to existing privacy regulations under sections 3701.17 and 3798.04.

• Enacts Section 3701.25 establishing that departments, divisions, boards of health, and contractors engaging in contact tracing must comply with voluntary participation requirements, consent provisions, and privacy protections for health information.

• Amends Section 5913.01 to authorize the adjutant general to designate Ohio National Guard members involved in remotely piloted aircraft operations, special forces operations, or cybersecurity duties as designated public service workers.
