HB 722 Summary

• Amends section 3767.41 of the Revised Code to add accumulation of garbage or debris inside a building or in its adjoining yard as a condition that may constitute a public nuisance

• For non-subsidized housing, requires that garbage or debris accumulation must exist for at least 30 days after the first code enforcement action before a civil action for abatement can be commenced

• For subsidized housing, maintains existing notice requirements giving landlords 60 days to remedy defective conditions before an abatement action may be brought

• Applies to buildings used for residential purposes, including mixed-use buildings with retail or commercial uses on some floors and residential uses on others, but excludes owner-occupied buildings with three or fewer residential units

• Existing section 3767.41 of the Revised Code is repealed and replaced with the amended version
