H.B. 792 Summary

• Amends Ohio Revised Code sections 3721.13, 3721.16, 3721.161, and 3721.162 regarding transfer and discharge procedures for residents in long-term care facilities

• Adds new resident rights (31-36) including the right not to be transferred to a location unable to meet health care and safety needs, and the right to adequate preparation prior to transfer or discharge

• Requires nursing homes to provide written notice at least 30 days in advance of proposed transfer or discharge to residents and sponsors, with exceptions for emergencies or health improvements

• Establishes an impartial hearing process conducted by the state department of health within 10 days if a resident challenges a proposed transfer or discharge within 10 days of receiving notice

• If a home transfers or discharges a resident before a hearing decision is issued and the department later determines the transfer was not compliant, the home must readmit the resident to the first available bed
