S.B. No. 117 Summary

• Requires all Ohio hospitals with organized emergency services to have a physician, physician assistant, clinical nurse specialist, certified nurse practitioner, or certified nurse-midwife available 24 hours per day to examine sexual assault victims and gather physical evidence.

• Mandates hospitals provide medically accurate information about emergency contraception to female victims of childbearing age and promptly offer emergency contraception, with explanation that it does not cause abortion.

• Requires hospitals to assess all victims' risk of sexually transmitted infections including gonorrhea, chlamydia, syphilis, and hepatitis; provide counseling on infections; and offer prophylactic treatment based on CDC guidelines.

• Mandates hospitals provide counseling on follow-up care benefits and information about local organizations and healthcare providers offering medical or mental health services to sexual assault victims.

• Allows minors to consent to all services without parental consent; establishes Department of Health complaint process; imposes civil penalties of at least $10,000 per violation for non-compliance; and permits court-ordered injunctions to restrict hospital operations for repeated violations.
