S.B. No. 222 Summary

• Authorizes persons to use auxiliary containers (bags, cans, cups, bottles, and similar packaging made of cloth, paper, plastic, cardboard, metal, or glass) for any purpose including commerce.

• Prohibits counties, townships, and municipal corporations from imposing taxes, fees, assessments, or charges on auxiliary containers, their sales, use, or consumption, except for standard sales and use taxes under existing law.

• Applies existing anti-littering laws to auxiliary containers by including them in the definition of litter under Ohio Revised Code Section 3767.32.

• Clarifies that the prohibition on container fees does not restrict the authority of counties, municipal corporations, or solid waste management districts to implement voluntary recycling programs.

• Amends sections 504.04, 715.013, 3736.01, and 3767.32 of the Revised Code and enacts new sections 301.30 and 3736.021.
