School district boards of education, community school governing authorities, STEM school governing bodies, and private school governing authorities shall determine whether to open school buildings for in-person instruction during the 2020-2021 school year.

Schools that open buildings for instruction may determine what health and safety measures to implement to address COVID-19, and may close buildings during the school year if the superintendent determines closure is necessary.

No public official other than school boards, governing authorities, or bodies may prohibit schools from opening, cause schools to close, or require adoption of COVID-19 safety measures for the 2020-2021 school year.

Qualifying parents providing home instruction may determine whether the building in which they provide instruction has adequate COVID-19 safety measures, and no public official may prohibit them from providing instruction based on COVID-19 implications or require them to adopt safety measures.

The act is declared an emergency measure effective immediately to take effect before the start of the 2020-2021 school year.
