Sub. S.B. No. 33 Summary

• Establishes civil liability for damage to critical infrastructure facilities, allowing owners/operators to recover compensatory damages equal to replacement value plus attorney's fees and court costs

• Makes willful destruction or tampering with critical infrastructure facilities a felony of the third degree under criminal mischief laws (Section 2909.07)

• Increases criminal penalties for trespass on critical infrastructure facilities to a misdemeanor of the first degree for unauthorized entry and a felony of the third degree for aggravated trespass with intent to destroy or tamper (Sections 2911.21 and 2911.211)

• Adds false alarms that impede critical infrastructure facility operations as a criminal offense under false alarm statutes, with enhanced penalties based on economic harm (Section 2917.32)

• Creates new offense of "improper organizational involvement with a critical infrastructure facility" punishable by fines up to ten times the maximum individual penalty for organizations that direct, authorize, facilitate, or encourage persons to commit these offenses (Section 2923.04)
