Attorney General shall investigate deaths of unarmed persons caused by peace officers engaged in their duties, regardless of detention status, and may investigate armed person deaths if significant questions exist about whether the person was armed and dangerous.

Attorney General must conduct full, reasoned, and independent investigations including gathering and analyzing evidence, conducting witness interviews, and reviewing investigative reports, scientific evidence, and audio and video recordings.

Attorney General has exclusive supervision and control of investigations with full prosecuting attorney powers including issuing subpoenas, compelling witness attendance, and compelling production of records; authority supersedes all other prosecutors.

When investigation warrants prosecution, Attorney General shall refer evidence to a grand jury and has sole responsibility to prosecute any resulting cases with all rights, privileges, and powers of a prosecutor.

Attorney General shall report to the Governor if declining to refer evidence to a grand jury or if a grand jury declines to indict, including an explanation of investigation outcomes and any recommendations for systemic reform.
