S.B. 377 Summary

• Eliminates court approval requirement for transfers of certain prisoners to transitional control programs during the final 180 days of confinement, allowing the Department of Rehabilitation and Correction to make transfers without sentencing court assent.

• Applies to eligible prisoners serving definite terms of two years or less (or minimum terms under non-life indefinite sentences) who committed offenses on or after July 1, 1996.

• Maintains victim notification by requiring at least 60 days' notice to victims before transfer and allowing victims to submit statements for the department to consider in transfer decisions.

• Preserves existing victim rights provisions ("Roberta's Law") related to notification of parole hearings, early release, and other release-related proceedings.

• Harmonizes conflicting amendments from previous legislative sessions (S.B. 66 and S.B. 201) to section 2967.28 regarding post-release control and parole supervision.
