S.B. No. 389 Summary

• Enacts the Occupational Therapy Licensure Compact, which allows occupational therapists and assistants licensed in one member state to practice in other member states through a "Compact Privilege."

• Establishes an Occupational Therapy Compact Commission composed of state delegates to administer the compact, promulgate rules, maintain a data system, and oversee compliance and dispute resolution among member states.

• Sets requirements for member state participation including licensing occupational therapists and assistants, conducting criminal background checks, reporting adverse actions, and maintaining a data system with licensure and disciplinary information.

• Allows licensed practitioners with a valid unencumbered license in their home state to obtain a Compact Privilege in remote states, subject to continuing education requirements, jurisprudence testing, and that remote state's laws and regulations.

• Requires Ohio's occupational therapy board to select a delegate to the Occupational Therapy Compact Commission within 30 days of the compact taking effect.
