Prohibits hospitals from requiring registered nurses or licensed practical nurses to work overtime as a condition of continued employment.

Makes it illegal for hospitals to terminate, discipline, or retaliate against nurses solely for refusing to work overtime.

Allows overtime requests during health care disasters, declared emergencies, unexpected patient influx events, and when nurses are engaged in ongoing medical treatment or surgical procedures necessary for patient safety.

Permits nurses to voluntarily work overtime and allows hospitals to offer overtime when nurses choose to accept it.

Requires hospitals to maintain evidence-based written nursing services staffing plans based on current standards and implemented within 90 days of convening a hospital-wide nursing care committee.
