Sub. H.B. No. 235 Summary

• Enacts the High Hazard Training Certification (HHTC) Act requiring contractors performing construction services at stationary sources subject to Clean Air Act risk management plan requirements to use only Class A skilled journeypersons, Class B skilled journeypersons, or apprentices

• Establishes implementation schedule requiring at least 65% of workers to be Class A skilled journeypersons or apprentices starting January 1, 2023, increasing to 80% by January 1, 2024

• Defines Class A skilled journeypersons as those who graduate from registered apprenticeship programs and complete 30-hour OSHA-approved safety training; Class B requires 6,000 hours of trade experience plus the same safety training

• Requires contractors and subcontractors to maintain payroll and apprenticeship records for five years and submit quarterly compliance reports to the director of commerce

• Establishes civil penalties of up to $10,000 per violation for owners, operators, contractors, and subcontractors failing to comply with training and workforce composition requirements
