H.B. No. 309 - Fair and Open Competition Act

• Prohibits public authorities from requiring or prohibiting contractors and subcontractors from entering into labor organization agreements or making union membership and dues payment conditions of employment on public improvement contracts.

• Denies state funding for construction of public improvements by political subdivisions that require or prohibit labor agreements in bid specifications or contracts.

• Allows public authorities to voluntarily award contracts to those who choose to enter into labor agreements, provided such agreement is not a condition for the award.

• Permits interested parties to file complaints in common pleas court within two years of contract signing for violations, with courts authorized to void contracts and award attorney's fees and costs to prevailing plaintiffs.

• Preserves rights and activities protected under the National Labor Relations Act and does not interfere with unregulated labor relations.
