H.B. No. 370 Summary

• Enacts the "Seizure Safe Schools Act" requiring public and chartered nonpublic schools to create individualized seizure action plans for each student diagnosed with a seizure disorder in collaboration with parents or guardians.

• Seizure action plans must include a signed parental request to administer seizure disorder medications and a written statement from the student's treating practitioner providing drug information and administration details.

• Requires schools to train at least one employee per school (aside from school nurses) on implementing seizure action plans consistent with Epilepsy Foundation of America guidelines, covering seizure recognition, appropriate treatment, and medication administration.

• Mandates all administrators, guidance counselors, and teachers complete a minimum of one hour of annual self-study training on seizure disorders, and requires all students receive age-appropriate instruction on seizure disorders as determined by the state board of education.

• Prohibits schools from denying enrollment to students with seizure disorders except when an IEP or 504 plan specifies care must be provided by a licensed health care professional at a different school, and provides liability protections for schools and employees unless willful or wanton misconduct is involved.
