Amended House Bill 371 Summary

• Adds digital breast tomosynthesis to the definition of screening mammography and requires coverage for women ages 35-64 through health insurance policies, sickness and accident insurance, public employee benefit plans, and Medicaid.

• Establishes coverage for supplemental breast cancer screening (magnetic resonance imaging, ultrasound, or molecular breast imaging) for women with dense breast tissue or increased risk factors as determined by their health care provider.

• Requires facilities to send patients a revised notification statement if mammograms show dense breast tissue, informing them that dense breast tissue can make cancer harder to find and may increase breast cancer risk, and recommending discussion with their health care provider.

• Limits reimbursement for screening mammography and supplemental breast cancer screening to 130% of the lowest Medicare reimbursement rate in Ohio and requires these services be performed only at American College of Radiology-accredited facilities or hospitals.

• Provides temporary relief for certificate of need holders granted between March 9, 2020 and June 18, 2021 by extending construction timelines and allowing ownership transfers; suspends civil penalties for capital expenditures between 110-150% of approved project costs for 24 months.
