School district superintendents and administrators of public or chartered nonpublic schools must file reports with the Department of Education (Superintendent of Public Instruction) regarding licensed teachers who resign or retire under threat of disciplinary investigation or termination.

Reports must be filed when an employee resigns or retires under threat of termination/nonrenewal, or because of or during an investigation into alleged conduct unbecoming to the teaching profession or specific offenses under Ohio Revised Code sections 3319.31 or 3319.39.

Reports must include the employee's name, social security number, and a factual statement regarding the applicable triggering condition for the report.

Board of education determinations, terminations, nonrenewals, resignations, retirements, or other separations do not create a presumption of guilt or innocence regarding alleged misconduct.

Individuals who provide information in good faith are immune from civil liability, and those required to file reports cannot knowingly fail to comply with reporting requirements.
