H.B. No. 406 - Voyeurism Offense Amendments

• Adds new definitions to Ohio law including "place where a person has a reasonable expectation of privacy" (a place where someone could fully disrobe in private) and "private area" (genitals, pubic area, buttocks, or female breast below the areola).

• Creates four separate voyeurism offenses: trespass to spy/eavesdrop for sexual arousal; recording another person in a state of nudity in a private place; recording a minor in a state of nudity in a private place; and secretly recording another person above, under, or through their clothing.

• Increases penalties for recording offenses by raising division (B) and (D) violations from misdemeanor second degree to misdemeanor first degree, with felony fifth degree for repeat offenders.

• Establishes felony penalties for division (C) violations involving minors, starting at felony fifth degree for first offense, escalating to felony fourth degree for one prior conviction and felony third degree for two or more prior convictions.

• Repeals existing sections 2907.01 and 2907.08 of the Revised Code to replace them with amended versions.
