Director of Aging shall establish a program to provide payment to residential care facilities housing Assisted Living waiver recipients, unless the medicaid-funded component is terminated.

Director of Medicaid shall establish a separate program to provide payment to residential care facilities meeting participation requirements in the medicaid-funded Assisted Living waiver.

Payment rates for residential care facilities are tiered based on percentage of residents participating in the medicaid-funded Assisted Living waiver, ranging from 35% to 60% of the average per medicaid day payment rate for all nursing facilities in the state.

Both directors must adopt implementing rules within 90 days of the effective date, with the Medicaid director consulting with the Aging director to ensure rule consistency.

Payment rates vary based on resident participation levels: 15-30% participation receives 35% of nursing facility rate, 30-50% receives 40%, 50-70% receives 50%, and 70%+ receives 60%.
