Sub. H.B. No. 81 Summary

• Shifts massage establishment regulation from township licensing of individual "masseurs/masseuses" to a registration system requiring all massage therapy providers to hold state licensure from designated boards (medical board, nursing board, chiropractic board, cosmetology board, occupational/physical therapy board, or be enrolled students).

• Allows township boards of trustees to regulate massage establishments through permits and registration requirements but prohibits them from independently licensing massage therapists or regulating the practice of medicine and related health professions.

• Prohibits conduct at massage establishments including touching sexual or genital areas, improper clothing, and employment of anyone under 18; establishes permit requirements with fees ($250 initial, $125 annual renewal) and denial/revocation grounds for applicants with sexual offense convictions or related violations.

• Establishes misdemeanor penalties: first degree for operating without a permit or employing unlicensed practitioners, and third degree for massage therapists performing prohibited sexual conduct or operating without required state licensure.

• Extends similar requirements to municipalities, prohibits advertising massage with suggestion of sexual activity, and repeals prior sections 503.45 and 503.46 establishing individual masseur/masseuse state licensing.
