Prohibits hospitals from requiring registered nurses or licensed practical nurses to work overtime as a condition of continued employment.

Defines overtime as work beyond a scheduled shift when notice is given during the shift and work must be performed immediately after the shift ends.

Prohibits hospitals from terminating employment or taking disciplinary action against nurses solely for refusing to work overtime.

Allows overtime in emergency situations including health care disasters, federal/state/county emergency declarations, unforeseen patient influxes, and when nurses are actively engaged in ongoing medical treatment or surgery.

Permits nurses to voluntarily work overtime and allows hospitals to offer or request overtime when nurses choose to accept it or maintain on-call schedules.
