Substitute Senate Bill 22 Summary

• Establishes the Ohio Health Oversight and Advisory Committee with 3 Senate and 3 House members (2 majority party, 1 minority party each) to oversee executive actions during states of emergency and health department orders.

• Allows the General Assembly to rescind executive orders, rules, and health department actions by concurrent resolution, with a 60-day waiting period before substantially similar orders can be reissued unless the General Assembly approves reinstatement.

• Limits states of emergency declared by the Governor to 90 days maximum, extendable only by concurrent resolution for additional 60-day periods, and allows the General Assembly to terminate emergencies after 30 days.

• Restricts health department quarantine and isolation orders, board of health orders, and local health district regulations to apply only to individuals medically diagnosed with disease or in direct contact with confirmed cases, prohibiting class-based restrictions.

• Provides that any orders or rules issued in violation of these provisions are invalid and have no legal effect, and grants persons who successfully challenge emergency orders the right to recover reasonable attorney's fees and court costs.
