Am. S.B. No. 236 Summary

• Amends Ohio Revised Code sections 1345.81 and 3901.41 to enable insurers to automatically enroll insurance purchasers in digital communications and modify requirements for using salvage motor vehicle parts in repairs.

• Allows insurers to automatically enroll customers who purchase policies through online platforms in electronic delivery of all notices and documents, unless the customer requests paper format.

• Requires insurers to clearly disclose the details of automated transactions, including the right to receive records on paper and procedures to withdraw consent, which must be effective within 10 business days.

• Modifies salvage motor vehicle part requirements by allowing insurers, repair facilities, and installers to use non-OEM aftermarket crash parts and salvage parts if sourced from a licensed salvage motor vehicle dealer and of like kind and quality.

• Maintains existing requirements that written estimates for non-OEM aftermarket crash parts include clear identification of parts and a notice in at least 10-point type explaining that warranties come from the parts manufacturer, not the vehicle manufacturer.
