Department of Health must adopt safety standards for donor human milk and milk-derived products, considering evidence-based national guidelines and addressing donor screening, milk handling, milk processing, and recordkeeping.

Health benefit plans issued on or after the effective date must cover medically necessary donor human milk for inpatient use, with milk obtained from banks meeting department standards.

Donor human milk coverage applies when ordered by a licensed health professional or board-certified lactation consultant for infants unable to receive maternal milk or whose parents cannot produce sufficient milk, with specific medical conditions enumerated including prematurity, gastrointestinal disorders, congenital heart disease, and immunologic deficiencies.

Health plans may impose prior authorization requirements for donor milk coverage, which must be treated as urgent care services.

Medicaid program must provide coverage for medically necessary donor human milk under the same medical necessity criteria and standards as health benefit plans, with medicaid director authorized to adopt implementing rules.
